RULING IN FSC 2257 CHALLENGE DENVER, CO -- United States District Court Judge Walker D. Miller has granted a preliminary injunction against enforcement of certain key provisions of U.S.C. 18 §2257 as regards FSC members. The ruling is currently being assessed by the FSC legal team and an analysis of the ruling will be made available as soon as possible on the FSC website. Initial readings of the ruling are heartening, especially for FSC members who fall in the category of so-called “secondary producers.” Until there are further legal proceedings, such as a trial or appeal process, or until there are further orders by Judge Miller, the government may not enforce §2257 against FSC members whose “activities do not involve the hiring, contracting for, managing, or otherwise arranging for the participation of the depicted performer”; in other words, those who are not the primary producers of sexual materials. This is in line with the 1998 10th Circuit Sundance v. Reno decision which many secondary producers, such as webmasters, have relied on -- and properly so, according to Judge Miller -- in deciding that secondary producers did not fall under §2257 record-keeping requirements.

In addition to the injunction against government prosecutions of secondary producers, FSC scored a crucial victory in convincing Judge Miller of the substantial likelihood that requiring producers to maintain URL’s for websites that are outside their control will be found to be overly burdensome. FSC attorneys also convinced Judge Miller of the substantial likelihood that the mind-boggling government insistence that chat rooms should have to store huge video recordings of chat room activities will be found overly burdensome. As a result, under this injunction, for now, the government may not enforce §2257 against members of FSC with regards to websites they do not control, or against FSC members as regards keeping video records in the operation of Internet chat rooms. Please note that the foregoing injunctions cite specific clauses of the revised §2257 and will need careful analysis by FSC attorneys to clarify the exact nature and full implications of the ruling.

FSC plans just such a timely clarification at the membership meeting in Las Vegas on Thursday, January 5, 2006, in Room 403 of the Sands Expo, Las Vegas, Nevada, adjacent to the Venetian Hotel and Casino. By then, FSC attorneys will have had time to analyze the ruling and will be in attendance to answer questions.

Another State Considers A Sin Tax

OLYMPIA, WA -- State Representative Kirk Pearson (R-Monroe) has announced that he will introduce a 25 percent sales tax bill on adult entertainment items such as videos, books and magazines when the Legislature begins its session in January. The revenues would be used to treat sex offenders and help their victims. "I believe there is a connection between hard-core pornography and deviant behavior of sex offenders," said Pearson. Similar proposals in Kansas, Texas and elsewhere have faced resistance from legislators. Washington will probably not be an exception, given a Democratic Majority in the House. A similar measure was passed in 1989, but was vetoed by the Governor. In Utah, a tax on adult entertainment was passed into law but is now on hold due to court challenges. If such a law were passed in Washington it would almost certainly be challenged as well, since it is patently unconstitutional to single out one form of protected speech for special taxation. "It is understandable why states consider doing this," said FSC Communications Director Tom Hymes. "They consider it a sin tax like other sin taxes such those on cigarettes. But adult entertainment is not a cigarette. It is a form of free speech."

In addition, women rate dances by symmetrical men relatively more positively than do men, and more-symmetrical men value symmetry in women dancers more than do less-symmetrical men. One measure of quality in evolutionary studies is the degree of bodily symmetry, because it measures developmental stability, the study said.

In contrast, housewives tend to be less demanding of their spouses and suppress their sexual urges.

The middle-class woman who is stressed with work and domestic life needs to find ways of venting her sexual frustration. This may be considered as something that could be ignored, but it is not healthy. Dr. Kamavat says, “The phenomenon of extramarital affairs is on the rise, simply because of lack of communication between partners, and the upwardly mobile woman can find other male friends or colleagues to share their feelings with, which may eventually end up turning into love. The marriage that the woman is in will obviously be on the rocks.

Women On The Pill May Lose Sex Drive

A new study has indicated that women who use contraceptive pills may lose their sex drive up to a year after they stop taking it. Loss of libido, muted or nonexistent orgasms and painful intercourse have long been known as side effects of the pill. Previous research had suggested a woman’s sex drive could return to normal within four weeks of discontinuation. But the seven years study by researchers led by Dr. Claudia Panzer, an Endocrinologist in Denver, Colorado shows that a chemical produced by the pill to stop ovulation continues to suppress testosterone levels - central to desire in men and women - for up to a year after women stop taking it.

Women on the pill had four times the level of Sex Hormone Binding Globulin (SHBG), which stops testosterone from circulating in the body, as those who had never taken the pill, it said. The research published this month in the Journal of Sexual Medicine was based on 124 pre-menopausal women attending a clinic for sexual dysfunctions. Half the women had used the pill, 39 had stopped using it and 23 had never taken it.

Scientists measured their SHBG levels every three months for a year. “It is important for physicians prescribing oral contraceptives to point out to patients the potential sexual side effects,” Panzer said. However a spokeswoman for Britain’s Family Planning Association urged caution in interpreting the findings. “It is difficult to quantify what a person’s sex drive is,” she said. She added: “It may be influenced by a range of lifestyle factors. Whether you are stressed, what you have eaten or how much you have drunk can all affect your sex drive. “Whether you have children and what ages they are can also have an effect. Our problem is that none of these factors was quantified in this research.”
